(1) Notwithstanding anything contained in Section 8, the Government of Nepal may remove the chairman or member from office in the following cases:-
(a) In case of lack of working capacity,
(b) In case of misconduct,
(c) Failure to faithfully perform his official duties,
(d) if the mental balance is not right or if the mind is disturbed, or
(e) In case of direct or indirect ownership or private interest in any firm or organization operating the telecommunication service or system.
(2) According to sub-section (1), before removing the chairman or member from office, he shall be given a reasonable opportunity to present his explanation.
